False Advertising and Product Liability (Chittenden, VT Superior Court)  –Conducted mock trial research, mock arbitration research, and witness communication training on behalf of the State of Vermont in a lawsuit involving allegations of false advertising and liability against RJR Tobacco related to the defendant’s Eclipse cigarette product.  After a more than one-month long bench trial, the presiding judge entered judgment in favor of the State of Vermont.


Product Liability – (Essex County, NJ Superior Court) – Conducted multiple focus group and mock trial research studies on behalf of an international pharmaceutical manufacturer in a class action product liability lawsuit in which its drug (Accutane) was alleged to have caused plaintiffs’ depression and subsequent suicides.


Employment Discrimination Class Action (U.S. District Court for the Central District of California) – Conducted mock trial research on behalf of the state of California in an employment discrimination class action brought against the California Highway Patrol alleging discrimination in the promotion process of its officers.  After a four week trial, the jury returned a verdict in client’s favor.


United States of America v. Jeffrey Skilling et al. (U.S. District Court for the Southern District of Texas) – Performed venue analysis and conducted focus group sessions in support of Defendant Skilling’s and Lay’s motion for a change of venue.


Insurance “Bad Faith” (U.S. District Court for the Western District of Washington) – Conducted mock trial research, assisted with jury selection, supervised shadow jury, and assisted with trial strategy in a matter believed to be the largest dental malpractice case in the history of the state of Washington.  Following a three-week trial, the jury rejected plaintiffs’ bad faith claim and awarded damages less than half the amount than had been sought by plaintiffs on their negligence and consumer protection act claims..


Kodak v. Sun Microsystems (U.S. District Court for the Western District of New York) – Assisted with multiple mock trial research sessions on behalf of the plaintiff in a patent infringement matter related to the “Khoyi patents,” in which defendant was alleged to have misappropriated technology that it thereafter incorporated into its JAVA software platform.  Following a six-week jury trial, plaintiff was awarded a $900 million verdict.


Mylan v. Esteve Pharmaceuticals (U.S. District Court for the District of Delaware) – Conducted several mock trial research sessions on behalf of the plaintiff who was suing defendants in a patent infringement matter related to a generic form of omeprazole, a medicine used to treat acid reflux disease.  The case settled on terms favorable to my client prior to trial.


Accounting/Auditing Malpractice – Conducted focus group, mock trial, and mock arbitration research in defense of international accounting/auditing firm in numerous state and federal matters alleging accounting and auditing malpractice.


Insurance Coverage/Toxic Tort (Summit County, OH Court of Common Pleas) – Conducted mock trial research on behalf of the plaintiff against more than 30 insurance companies in an environmental-related insurance coverage dispute involving cleanup of a formerly owned site.  After a seven-week trial, the jury awarded plaintiff $42 million.


White Collar Criminal (United States District Court for the Southern District of New York) – Conducted focus group, mock trial and juror profiling research on behalf of a defendant executive employee of an international advertising and public relations firm in a criminal case in which he was alleged to have fraudulently billed the Office of Drug Control Policy (ODCP) for print and media expertise provided on the ODCP’s “Just Say No” public service campaign.


Wrongful Death (Circuit Court of Roane County, WV) – Conducted focus group research on behalf of a defendant utility company in a wrongful death lawsuit arising out of a natural gas pipeline explosion.  Case settled on favorable terms to client prior to trial.
